These Terms of Use (“Terms”) form a legal agreement between you and Nona Technologies, Inc. (“Nona Technologies,” “we,” “us,” or “our”) and govern your access to and use of the website located at www.nona-technologies.com and any related subdomains (the “Site”). By accessing or using the Site, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree with these Terms, you should not access or use the Site.

These Terms apply to your use of the Site as an informational and marketing resource. They do not alter the terms of any separate written agreement you may enter into with us for the purchase, pilot, evaluation, or supply of our products or services, which will control in the event of a conflict.

The Site is intended for business and professional users who are at least 18 years of age. By using the Site, you represent that you are at least 18 years old and that you have the authority to accept these Terms on behalf of yourself or any organization you represent.

The content on the Site — including descriptions of our Ion Concentration Polarization (ICP) technology, the NONA RECOVER system, performance figures, calculators, case examples, and other materials (collectively, the “Content”) — is provided for general informational purposes only. Performance figures, savings estimates, and calculator outputs are directional, depend on site-specific conditions such as water chemistry and cooling load, and are not guarantees of results. Nothing on the Site constitutes engineering, technical, legal, financial, or regulatory advice, and you should not act on Site Content without consulting our technical team or a qualified professional.

We use reasonable efforts to keep the Content accurate and current, but it is subject to change without notice and we do not warrant its accuracy, completeness, or usefulness. Any reliance you place on the Content is at your own risk.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, NONA TECHNOLOGIES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE SITE, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

You agree to indemnify and hold harmless Nona Technologies and its officers, directors, employees, and affiliates from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the Site, your violation of these Terms, or your violation of any law or the rights of any third party.

11. Governing Law and Disputes

These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Site will be subject to the exclusive jurisdiction of the state and federal courts located in Massachusetts, and you consent to personal jurisdiction there.

We may revise these Terms from time to time in our sole discretion. When we do, we will update the “Last updated” date above. Changes are effective when posted. Your continued use of the Site after changes are posted constitutes your acceptance of the revised Terms.
